When maritime transits or customs delays leave an inbound lot below that copied percentage, receiving departments often threaten rejection as if the consignment violated FDA, EU MDR or ISO 11607. This guide separates those instruments. By reading FDA April 1991, 21 CFR 801.18, EU MDR Annex I GSPR 6, 7, 11.4 and 23.2, UNICEF's current October 2023 medical-device technical requirements, WHO TRS 1044 Annex 8, and the WHO specification-corpus census, it gives distributors and OEM sellers a remaining-life RFQ matrix instead of another aging-method HOW file.

Does FDA April 1991 or 21 CFR 801.18 set a remaining-percentage-at-delivery rule for medical devices?

A pervasive myth in international procurement is that the United States Food and Drug Administration (FDA) mandates a minimum remaining shelf life—frequently asserted as 75% or 80%—when medical devices enter commercial distribution or arrive at a healthcare facility. This assumption conflates premarket device stability validation with postmarket commercial purchasing contracts. The primary regulatory foundation for expiration dating under US law derives from the FDA Center for Devices and Radiological Health (CDRH) guidance document titled Shelf Life of Medical Devices, issued in April 1991 (with content confirmed current by FDA as of March 27, 2018) 1, 2.

The April 1991 guidance informs medical-device manufacturers how to establish, scientifically justify, and document a device's shelf life and expiration date. In the guidance text, FDA defines shelf life as 'the term or period during which a commodity remains suitable for the intended use' and defines expiration date as 'the termination of shelf life, after which a percentage of the commodity, e.g., medical devices, may no longer function as intended' 2. The document outlines stability-testing considerations and recognizes that some simple devices (such as tongue depressors) may not need a labelled shelf life because the likelihood of time-dependent degradation and the seriousness of failure are both low 1. Nowhere in that guidance does FDA set a remaining-percentage-at-delivery rule for importation, wholesale transfer, or hospital receiving.

Similarly, federal labeling regulations under 21 CFR 801.18 (Format of dates provided on a medical device label) 3 govern only the typographical format of printed dates on device labels and packages. The UDI final rule added this section: whenever a medical device label includes a printed expiration date, date of manufacture, or any other date intended to be brought to the attention of the user, the date must be presented as four-digit year, two-digit month and two-digit day, separated by hyphens (for example, 2014-01-02) 3. The printed exceptions are a combination product that properly bears a National Drug Code (NDC) number, and an electronic product whose date of manufacture is presented under 21 CFR 1010.3(a)(2)(ii). Neither exception is a remaining-percentage dock test, and 801.18 does not require every device to carry an expiration date. A use-by symbol on artwork is a separate label-clock from remaining months at a named Incoterms point; see ISO 15223-1 EU REP symbol acceptance after 17 June 2026. Federal device law does not prohibit distribution, sale or use of a sterile device solely because remaining shelf life has fallen below 75 or 80 percent, provided the labelled expiration date has not passed, the sterile barrier remains intact, and storage has followed the manufacturer's labelled conditions.

What do EU MDR GSPR 6, 7, 11.4 and 23.2(i) require, and why is that not 75 percent remaining at import?

In the European Union, the regulatory regime under Regulation (EU) 2017/745 on medical devices (EU MDR) 4 addresses device lifetime, packaging integrity, and labeling through the General Safety and Performance Requirements (GSPR) set out in Annex I. Just as with US FDA regulations, European economic operators frequently encounter tender clauses or port-of-entry customs demands claiming that the EU MDR mandates a 75% or 80% remaining shelf life upon physical import into the Union. An examination of the statutory legal text of Annex I proves that no such percentage requirement exists under European Union law.

The governing GSPR articles operate on functional safety and barrier integrity rather than commercial percentage clocks: 4

  • GSPR 6 (Lifetime and Maintenance): Requires that the characteristics and performance of a device must not be adversely affected to such a degree that the health or safety of the patient or user and of other persons are compromised during the lifetime of the device, as indicated by the manufacturer, when the device is subjected to the stresses which can occur during normal conditions of use and has been properly maintained in accordance with the manufacturer's instructions.
  • GSPR 7 (Transport and Storage Design): Dictates that devices must be designed, manufactured, and packaged in such a way that their characteristics and performances during their intended use are not adversely affected during transport and storage conditions (for example, fluctuations of temperature and humidity) taking into account the instructions and information provided by the manufacturer.
  • GSPR 11.4 (Sterile Packaging Integrity Until Point of Use): Explicitly establishes the legal performance threshold for terminally sterilized medical devices: 'Devices delivered in a sterile state shall be designed, manufactured and packaged in accordance with appropriate procedures, to ensure that they are sterile when placed on the market and that, unless the packaging which is intended to maintain their sterile condition is damaged, they remain sterile, under the transport and storage conditions specified by the manufacturer, until that packaging is opened at the point of use.'
  • GSPR 23.2(i) and 23.2(j) (time limit and date of manufacture): The label must bear 'an unambiguous indication of the time limit for using or implanting the device safely, expressed at least in terms of year and month, where this is relevant'. Where there is no indication of the date until when the device may be used safely, GSPR 23.2(j) requires the date of manufacture. A separate particular, GSPR 23.2(k), requires an indication of any special storage and/or handling condition. None of those label particulars sets 75 percent remaining at import.

EU MDR GSPR 11.4 establishes a binary physical performance test: the device remains sterile and functional until the packaging is opened at the point of use, provided the sterile barrier is undamaged and storage conditions have complied with the manufacturer's instructions 4. Notified Bodies audit the manufacturer's Technical Documentation—specifically the stability studies conducted under ISO 11607-1 and ISO 11607-2 packaging validation, aging and lot-release tests—to confirm that the sterile barrier and device components maintain their specification until the year and month indicated under GSPR 23.2(i). Neither GSPR 11.4, the European Commission's MDCG guidance documents, nor EU customs legislation establishes a 75% remaining shelf life clock at import. An EU distributor or hospital that refuses a shipment on the grounds that MDR requires 75% remaining shelf life is confusing an internal institutional procurement rule with a European Union statutory mandate.

What does UNICEF October 2023 actually print for total shelf life and remaining life at delivery?

If remaining shelf life percentages are absent from US and European device statutes, where did the international procurement habit of demanding a fractional remaining life originate? The most influential institutional source in global health procurement is the United Nations Children's Fund (UNICEF) Supply Division. The live UNICEF medical-devices technical-requirements landing 6 currently posts Technical Requirements for Medical Devices (MD) — Generic, October 2023 5. That current file—not the January 2019 predecessor 17—is the UNICEF MD term a supplier should quote in September 2026.

Under Section 5 (Product shelf life / life span), UNICEF October 2023 prints three interconnected operational requirements: 5

  • Minimum total shelf life floor: 'Products with a shelf life of less than 5 years are normally not acceptable; however, in special circumstances UNICEF may accept shorter shelf life.' The January 2019 predecessor used a 36-month floor; the current October 2023 file raised that usual floor to five years.
  • The two-thirds remaining rule: 'The supplier shall ensure that two thirds of the shelf life remain at delivery unless specifically authorised in writing by UNICEF prior to delivery.'
  • Remedy for non-compliance: 'Any product delivered with less than two thirds remaining shelf life, shall be rejected by UNICEF, at no cost to UNICEF. The supplier shall be responsible for and bear the costs for returning the goods.'

The mathematical reality of UNICEF's remaining-life clause is immediately apparent: two thirds is about 66.7 percent, not 75 percent and not 80 percent. UNICEF also prints that two-thirds remaining rule for neighbouring commodity families: the Technical Requirements for In Vitro Diagnostics (IVD, November 2021) 7 and for Personal Protective Equipment (PPE, April 2022) 8. Those IVD and PPE files do not copy the MD five-year total-shelf-life floor. In UNICEF's operational framework, the two-thirds buffer is a buyer contract term complete with a written-deviation mechanism. When commercial distributors copy 'two thirds'—or inflate it to 75 or 80 percent—into a private hospital RFQ, they transform UNICEF's logistics buffer into an arbitrary trade barrier. Pasting the January 2019 36-month floor into a 2026 UNICEF MD bid is equally stale: the current usual floor is five years.

What is WHO TRS 1044 Annex 8, and why is Appendix 1 a months table after risk assessment rather than a 75 percent law?

The second major international reference frequently cited in tender disputes is the World Health Organization (WHO) Technical Report Series No. 1044 (published in 2022). Annex 8 of TRS 1044 is titled Points to consider for setting the remaining shelf-life of medical products upon delivery 9, 10. Developed under the auspices of the WHO Expert Committee on Specifications for Pharmaceutical Preparations, this guidance represents a landmark attempt to harmonize remaining-shelf-life principles across international humanitarian agencies, donor organizations, and recipient governments.

Significantly, TRS 1044 Annex 8 extends remaining-life principles beyond finished pharmaceuticals. The introduction records that the document 'should cover not only finished pharmaceutical products but should be extended to cover other products, including medical devices, vaccines and in vitro diagnostics (IVD) products,' collectively referred to as medical products 9. The glossary defines remaining shelf-life as 'the period remaining from the date of delivery to the expiry date, retest date, install-by date or other use-before date established by the manufacturer' 9. Instead of a 75 or 80 percent formula, Section 5.1 requires remaining life to be defined realistically after a documented risk assessment that considers product type, inventory, manufacturing and transit lead time, local release, storage, the delivery chain, and resources in the recipient country.

Appendix 1 of TRS 1044 Annex 8 is an example table of minimum remaining shelf-life, in absolute months, at three named handoff points after risk assessment: 10

  • 48 months < TSL ≤ 60 months: 40 months remaining at dispatch from the manufacturer's premises; 30 months at delivery at port of entry; 12 months at end-user level.
  • 36 months < TSL ≤ 48 months: 30 months at manufacturer dispatch; 24 months at port of entry; 12 months at end user.
  • 24 months < TSL ≤ 36 months: 20 months at manufacturer dispatch; 15 months at port of entry; 6 months at end user.
  • 12 months < TSL ≤ 24 months: 9 months at manufacturer dispatch; 7 months at port of entry; 3 months at end user.
  • TSL ≤ 12 months: special arrangements and conditions apply.

Three principles follow from the live table 10. First, the cells are absolute months, not fixed percentages. For a device in the 48 months < TSL ≤ 60 months band, 30 months remaining at port of entry is 50 percent or less of labelled life—below the 75 or 80 percent often claimed by buyers. Second, remaining life is stage-dependent: manufacturer dispatch, port of entry, and end user are different clocks. Third, Appendix 1 is an example. Section 5.1 states that remaining-life or expiry-date responsibilities should be covered in agreements between suppliers, purchasers and recipients 9. WHO also recommends that national policy consider the document; that recommendation still does not convert Appendix 1 into an FDA or EU remaining-percentage statute.

The WHO medical device procurement specification corpus: 4,070 rows and zero remaining-percentage mandates

To determine whether international health authorities incorporate remaining-shelf-life percentages into standardized medical-device procurement specifications, an empirical census was conducted across the World Health Organization's official medical-device technical specifications corpus 12. The analyzed dataset, drawn from the comprehensive August 26, 2026 snapshot, encompasses 4,070 standardized specification field rows covering 74 unique medical devices and priority life-saving commodities (spanning the WHO 61-device core technical workbook and 13 priority maternal, newborn, and surgical commodities).

The census counted every Shelf life (if relevant) cell across those 74 device records. The findings are: 12

  • Universality of the Field: The standardized specification field label 'Shelf life (if relevant)' appears on 100% of the device specification sheets (all 74 unique devices).
  • Unpopulated or Not-Applicable Cells (65 Devices): In 65 out of 74 devices (87.8%), the field is either left blank, designated 'N/A', or refers to general durability, reflecting the fact that capital equipment, surgical instruments, diagnostic hardware, and non-perishable consumables do not degrade under shelf aging.
  • Populated Total Shelf Life / Useful Life Cells (9 Devices): Only 9 device specifications populate the field with specific temporal parameters: capital equipment like diagnostic spirometers, floor scales, fetal heart monitors, and electrosurgical diathermy units populate the field with an expected service life of '10 years'; portable mechanical ventilators record 'Variable'; female condoms specify a claimed total shelf life of 'not less than 3 years and not more than 7 years'; and single-use injection syringes (re-use prevention / RUP and non-RUP syringes) and suction catheters include standard stability notes indicating that empirical evidence typically supports shelf lives up to 5 years.
  • Remaining-Percentage-at-Delivery Mandates (Zero Devices): Across the entire corpus of 4,070 field rows and 74 medical devices, exactly zero devices (0.0%) contain a specification requiring a remaining shelf life percentage (such as 75% or 80%) upon delivery.

That specification-sheet finding is consistent with WHO's current Invitation-to-Bid / Request-for-Quotation technical-requirements document (Version 5, January 2026) 18. In the pharmaceutical shelf-life section, WHO states that at purchase-order stage, unless authorised in writing in advance, the TRS 1044 Annex 8 remaining-life guidance applies. In the medical-devices document list, the same file asks for ISO 13485 or ISO 9001, ISO 10993 biocompatibility, ISO 14971 risk assessment, and sterility/stability standards such as ISO 11135 and ISO 11137. It does not copy the Appendix 1 remaining-percentage or months table into those device sheets. Remaining life at a named delivery point therefore remains an exceptional, commodity-specific contract term unless the buyer has actually written UNICEF two thirds, WHO Appendix 1 months, or its own clause into the RFQ.

Does ISO 11607-1, ASTM F1980, or Rec 14-594 set remaining life at the dock?

A frequent point of friction during incoming receiving inspections occurs when hospital procurement officers cite packaging validation standards—most notably ISO 11607-1:2019 11, ASTM F1980 (accelerated aging), or FDA Recognized Consensus Standards—as technical justification for demanding 80% remaining shelf life. In fact, this site's own historical commercial guidance (such as the bulk-price FAQ in the landed-cost, MOQ and short-dated-stock gates for a circumcision-device bulk order) previously noted that international buyers commonly demand an 80% remaining shelf life buffer while referencing ISO 11607. From an engineering and regulatory perspective, that association is an internal misattribution that must be clearly dismantled.

ISO 11607-1:2019 (Packaging for terminally sterilized medical devices — Part 1: Requirements for materials, sterile barrier systems and packaging systems) 11 governs the physical, chemical, and microbiological integrity of sterile packaging. Its scope is explicitly defined: to establish requirements and test methods for materials, preformed sterile barrier systems, and packaging systems that are intended to maintain sterility of terminally sterilized medical devices until the point of use. Under ISO 11607-1, a sterile barrier system is validated through rigorous empirical testing: sterile barrier seal integrity (ASTM F88 peel testing, ASTM F1929 dye penetration), microbial barrier properties, transit simulation (ASTM D4169), and real-time and accelerated aging (ASTM F1980) 11. If a sterile barrier system demonstrates valid seal strength and barrier integrity at the 3-year or 5-year aging timepoint, the packaging complies with ISO 11607-1 throughout every single day of that validated period.

Nothing in ISO 11607-1, ISO 11607-2 (process validation), or ASTM F1980 establishes a dock clock, a warehouse velocity rule, or an incoming-inspection percentage threshold. A blister pack that arrives at a hospital with 6 months of remaining shelf life on a 3-year validated expiry has the exact same sterile barrier integrity as one that arrives with 28 months of remaining shelf life, assuming storage temperatures and transport conditions have remained within validated limits. Waving an ISO 11607 Declaration of Conformity (DoC) does not prove that a device meets an 80% remaining-life tender clause, and missing an 80% tender clause does not indicate non-compliance with ISO 11607.

Why do tenders copy 75 percent, 80 percent, 18 months or two thirds, and which neighbouring commodity each number actually belongs to?

If remaining shelf life percentages are not medical device statutes, why do hospital tenders, defense procurement RFQs, and national health tenders across the Middle East, Southeast Asia, Latin America, and Africa uniformly demand 75%, 80%, 18 months, or two thirds? The answer lies in institutional procurement history and the widespread practice of tender template copying. Hospital tender committees rarely draft procurement specifications from scratch; instead, administrative staff borrow language from neighboring commodity contracts, institutional donor templates, or legacy pharmacy guidelines. Tracing these specific numbers to their true origins clarifies why they are misapplied to sterile single-use devices.

Each widely copied tender metric originates from a specific regulatory or commercial sector: 5, 9

  • The 80 percent metric (short-dated IVD reagents and diagnostic kits): Hospital and national tenders often copy an 80 percent remaining-life buffer used for short-dated liquid reagents, controls and diagnostic kits. That neighbouring-commodity practice is not a sterile-device statute, and it is not printed in FDA April 1991, 21 CFR 801.18, MDR GSPR 11.4, UNICEF MD October 2023, or WHO TRS 1044 Appendix 1. Copying it onto a circumcision blister or stapler treats biochemical reagent decay as if it were polymer or metal hardware aging.
  • The 75 Percent Metric (Pharmaceutical Wholesaling & GMP Distribution): The '75% remaining shelf life' standard is a commercial convention originating in wholesale pharmaceutical distribution. Frequently asked questions

Is there a US remaining-shelf-life percentage statute for medical devices on 11 September 2026?

No. There is no US federal statute, regulation, or FDA guidance setting a mandatory remaining-shelf-life percentage at importation, commercial delivery, or hospital receiving. FDA's April 1991 guidance (Shelf Life of Medical Devices) 1, 2 establishes how manufacturers determine and justify expiration dates based on empirical stability data. 21 CFR 801.18 3 mandates the YYYY-MM-DD typographical format when dates appear on labels, but it does not govern inventory aging or dock receiving percentages. Any 75% or 80% requirement in the US is strictly a private commercial purchasing covenant.

Does EU MDR GSPR 11.4 require 75 percent remaining shelf life at import?

No. Missing a tender remaining-shelf-life percentage is a breach of a commercial purchasing contract, not a violation of device safety laws. A legally cleared or CE-marked medical device stored under validated conditions remains fully legal to distribute, sell, and use right up until its printed expiration date. Does the 20 December 2026 Rec 14-530 packaging-DoC clock change remaining shelf life?
