Which Certificate Covers a Chinese Device After a Class Change

When a supplier says an NMPA class adjustment changed the certificate on file, which document a buyer may still cite, and when a shipment has to stop.

The certificate a buyer already has on file

An international distributor, private-label buyer, or hospital procurement lead holds a Chinese supplier's registration certificate or Class I filing number. That number is already on an import file, a tender, or a quality agreement. The factory then says an NMPA classification adjustment has changed the product's management class. The decision is which document may still be cited, which remarks have to be on the replacement, and when a shipment has to stop.

On 1 June 2026 the National Medical Products Administration published Announcement No. 52 of 2026, index FGWJ-2026-10051, signed 29 May 2026. The Chinese title is 国家药监局关于医疗器械分类调整有关工作的公告(2026年第52号). It takes effect on publication. The same day NMPA published Announcement No. 53, which issues a revised catalogue-adjustment procedure and repeals the 2021 No. 60 procedure, and an interpretation, index FGWJ-2026-10043.1, 2, 3

Announcement No. 52 covers medical devices, including in vitro diagnostic reagents. It says what registration or filing work follows a change in management attribute or management class. It has no product annex. It does not assign a new class to any named device, including any device in this catalogue.1 How to decode a number that is already on the file is a separate job, covered in how to read an NMPA registration or filing number.

If the specific adjustment document sets a special rule for the old certificate's validity, or any other special registration or filing rule, that document controls. Otherwise No. 52 applies.1 A supplier summary that does not attach the adjustment document has not shown which certificate still covers the shipment.

Which date controls the certificate: the class-adjustment day or the end of the transition?

The interpretation defines two dates, and it says they are not the same thing. The class-adjustment day (管理类别调整之日) and the attribute-adjustment day (管理属性调整之日) are the implementation dates written in the relevant NMPA adjustment document. They are not the last day of a registration or filing transition, if one is set.2

From the class-adjustment day, a first registration application is accepted under the new class. An application that was already accepted and not yet decided may continue under the old class. If it is approved, the remarks note the adjusted class. If that adjustment has a registration transition, the certificate's validity must not pass the transition end.1 A renewal application that was already accepted and not yet decided follows the same pattern: review may continue under the old class, the remarks note the adjusted class, and a transition caps the validity at the transition end.1

For a domestic device, Decree No. 47 Article 8 places a Class I filing with the drug regulatory department of a city divided into districts, a Class II registration with the provincial department, and a Class III registration with NMPA.4 A move between those classes therefore changes who receives the next application. That split is the domestic rule. It is not the rule for an import registration. The signature date 29 May 2026 is not a second effective date. The announcement is implemented from its 1 June 2026 publication.1

Does a lower new class cancel the registration certificate you already hold?

No. 52 does not use a down-class move to cancel the certificate on the adjustment day. For a certificate approved before that day, if the class moves from higher to lower, the holder applies when continuation is needed. The application is a renewal or a filing under the new class, made to the authority for that new class. If the renewal is granted, the remarks of the registration certificate record the original registration certificate number. If the product moves to Class I and the filing materials meet the regulations, the filing is completed and the remarks of the filing information form record the original registration certificate number.1

The sentence that the existing certificate remains valid comes from Decree No. 47 Article 65, in the English convenience text: where management classification is adjusted from a higher class to a lower one, the registration certificate within its period of validity remains valid. Where a renewal is needed, the registrant applies for renewal or filing on the changed classification six months before that validity expires.4 No. 52 adds the remarks requirement and the path into a Class I filing. It does not replace Article 65. The Chinese text of the decree controls if the English wording differs. Article 58 of the same English text says a medical device registration certificate is valid for five years. That five-year term is a registration certificate. It is not a statement that a Class I filing expires on the same clock.4

Read the two texts together. Until expiry, the buyer can still be shown the current higher-class certificate, unless the specific adjustment document says otherwise. At renewal, the new document has to be the lower class, and it has to carry the old number in the remarks. Announcement No. 52 does not order a recall, and it does not require the factory to apply for the lower-class document on the adjustment day. If the adjustment document sets its own validity rule, that document controls.1, 4

A move from Class III to Class II changes the domestic reviewing authority from NMPA to the province. A move from a registered class to Class I changes the next document from a registration certificate to a municipal filing.4 Those are consequences of Article 8. They are not a finding that any current catalogue code has moved.

When may the supplier renew under the old class instead of the new one?

For a certificate approved before the adjustment day, a move from a lower class to a higher class requires an application under the new class. The original certificate must not extend beyond the transition end stated in the adjustment document. That is the ordinary rule. It is not the rule for every sentence in the same paragraph.1

The announcement then draws a narrower line: 对于随着技术发展,明晰产品管理类别应当是第三类医疗器械的,管理类别调整之日前批准的第二类医疗器械注册证在有效期内继续有效。 Where it has become clear that the product should be Class III, a Class II certificate approved before the adjustment day remains valid during its validity period.1 That sentence does not say the certificate is cut off at a transition end. A buyer who treats every Class II-to-Class III move as "capped at the transition end" has dropped this sentence. A buyer who treats every up-class move as "valid until the printed expiry" has dropped the ordinary rule.

Asia Actual's scenario table, reviewed on 29 September 2026, describes an upward move as validity until the transition end, with a conditional renewal if the certificate expires sooner. That table does not print this Class II-clarified-as-Class III sentence.5 Qualtech's English sectioning does include it.6 Neither page is the operative text. The distinction has to be taken from the announcement, and from whether the adjustment document itself says the product has been clarified as Class III.

A renewal under the old class is allowed only in a defined case, not as a general grace period. All of the following have to be true. The holder has already applied for registration under the new higher class while the original certificate was still valid. The original certificate expires before the transition end, if a transition is set. The product is safe and effective, and no serious adverse event or quality accident has occurred since marketing. The holder may then apply to the original registration authority for renewal under the old class. If that authority grants it, the remarks note the adjusted class, and the validity must not extend beyond the transition end.1

The renewed document is a bridge to the transition end. It is not a new five-year certificate, and it is not available merely because a higher-class dossier would take a long time. Decree No. 47 Article 65 already required an up-class application within the time the adjustment notice sets. No. 52 adds this capped renewal and the Class III clarification. It does not tell registrants to stop every old-class renewal on the announcement date.1, 4

Once the holder obtains the registration certificate for the changed class, the holder must actively apply to cancel the original certificate. If the holder does not, the original registration authority carries out the cancellation procedure. The announcement states that duty in the first-registration section and again after the up-class rules.1 Failing to cancel does not leave both certificates in force. It also does not, by itself, tell a foreign customs authority to seize a shipment. The buyer's practical step is to obtain the new certificate, the cancellation record, and an updated destination-market file before the old number is the only number on the import permit.

A later change to a certificate already issued, including one renewed under the old class during an up-class transition, is made to the original registration authority. The change document notes the adjusted class.1

Class I is a separate crossover. From the adjustment day, a product moved down to Class I may be filed as Class I. If a first registration had already been accepted and not decided, the applicant may either take the old-class certificate under the in-process rule or ask for the review to be terminated, with the file archived.1 A Class I product moved up must be registered under the new class, and the filer must actively cancel the old filing. If that filing is not cancelled by the transition end, where one is set, the original filing authority announces the cancellation.1 Before that end, a change to the filing information or to the filed product technical requirements is made to the original filing authority, with an explanation and the adjustment document.1

What must the remarks column show if a tender still cites the old number?

The remarks column matters because a tender or an import permit may still print the old number after the class has moved. The announcement does not prescribe one Chinese sentence that every replacement document must carry. It specifies different content for different paths.1

  • Down-class renewal or Class I filing. The remarks record the original registration certificate number. On a filing, that note is on the filing information form.1
  • In-process approval, change approval, and the conditional old-class renewal. The remarks record the adjusted class. Where a registration transition exists, validity is limited so that it does not pass the transition end.1
  • A tender that still cites the old number on another path. The interpretation says that if, for tender or procurement reasons, the registrant or filer needs the original registration number or the original filing number in the remarks, they must say so when they submit the first registration, the renewal, or the filing.2

The buyer's request follows that split. On a down-class replacement, require the old registration number in the remarks, because No. 52 already requires it. On any other replacement, if the destination file still cites the old number, require evidence that the supplier asked for that number to be noted at the time of the application. A blank remarks box is a gap. An invented template sentence is not the test. The test is whether the required content is there.

When does a missing new certificate stop production, sale, or import?

自管理类别调整的注册/备案过渡期截止之日(如有)起,未依法取得医疗器械注册证或者办理第一类医疗器械产品备案的,不得生产、经营和进口。— NMPA Announcement No. 52 of 2026, Section I(7)

From the end of the registration or filing transition, where one is set, a product that has not lawfully obtained a medical device registration certificate or completed a Class I product filing must not be produced, dealt in (经营), or imported.1 The announcement lists those three activities. It does not add a separate export verb, and it does not say whether goods that have already left China may still be sold. That is a destination-market question. The same end point applies to a product that has newly been brought under device regulation: from the transition end, where one is set, production, dealing, and import stop without the certificate or the Class I filing.1

Two limits keep this sentence from being used as a universal cancellation. The words "where one is set" are in the text (如有). Announcement No. 52 does not itself create the transition end, so a missing length in No. 52 is not a day-one production ban. And the sentence does not say that stock manufactured before the end may be sold until the labeled expiry date. It also does not set a fine. A penalty article in the device regulations is a different instrument from No. 52 and from Decree No. 47. This page does not treat either document as a fine schedule.

The ordinary up-class rule and this stop rule fit together. After the transition end, the old certificate must not still be the document that makes production, dealing, or import lawful. The Class II certificate that the announcement says remains valid for its term, because the product is clarified as Class III, is a different sentence. While that certificate is inside its own validity period, the buyer should not describe it as already dead at the transition end. At its own expiry, the Class III certificate is the document the next period requires.1

Section III is the exit from device regulation. From the attribute-adjustment day, the product is no longer regulated as a medical device. Authorities stop processing device filings and stop accepting device registrations. A review that was accepted and not finished is terminated and archived.1 The section does not say that an already issued certificate remains valid until expiry. It does not say the opposite in a validity sentence either. It does not give a date for stripping device claims off the label. That silence should stay a silence until the specific adjustment document, or a later official reading, fills it.

A manufacturer-facing summary of the same announcements states that No. 52 expressly leaves an exited product's certificate usable until expiry, and it tells companies facing an up-class move to stop renewal applications under the old class immediately.7 Neither instruction is a sentence in the announcement. The conditional renewal above exists so that some old-class renewals can still be granted. The exit section does not contain a validity-until-expiry rule.

What Announcement No. 53 adds, and what it does not start

Announcement No. 53, also published on 1 June 2026, issues the revised working procedure for dynamic adjustment of the classification catalogue and repeals the 2021 No. 60 procedure as of that publication.3 The procedure is the attachment to that announcement. The two-year, three-year, and five-year figures in this section are taken from the interpretation's quotation of Article 10 of that procedure. They are not a second extraction of the attachment.2

The interpretation quotes Article 10 as generally setting a transition of two to three years when a product is brought under Class II or Class III regulation, or is moved from a lower class to a higher class. The quotation says the registration transition is generally two years when no clinical trial is required and generally three years when one is required. A further quoted point allows more than three years and, in principle, not more than five.2 Those are principles for writing a future adjustment document. They did not start a transition on 1 June 2026 for devices in general. A supplier who claims a three-year or five-year grace has to show the end date in the adjustment document that names the product.

The same interpretation says No. 52 applies when NMPA publishes an adjustment of a specific device or of a whole category. An individual classification determination made for a regulatory need follows the registration rules and the classification-defining announcement. It does not follow No. 52.2 A letter about one product is not, by that fact alone, a catalogue adjustment with these transition rules.

The 24-, 36-, and 60-month bars are the interpretation's quotation of procedure Article 10 for a future adjustment that brings a product under Class II or III or moves it to a higher class. The 60-month bar is a drafting ceiling. It is not the five-year life of a registration certificate, and it is not a grace period No. 52 has already granted.

Documents to require before the next shipment

Use the supplier's email as a prompt to collect the adjustment document, not as the adjustment document. Before the next lot is accepted against the old number, the file should contain the following.

  1. The NMPA adjustment document that names the product or the category. Announcement No. 52 is the procedure. It is not that document. The file needs the implementation date and, if the document sets one, the transition end.1, 2
  2. The certificate or filing that is in force today, with its validity dates. Check the number the way the certificate-reading guide describes. A provincial registration number and a national registration number are not the same query.
  3. The direction of the change. Down-class, ordinary up-class, Class II clarified as Class III, Class I crossover, entry into device regulation, and exit from device regulation are different rows in the table above. A single "the class changed" sentence does not select the row.
  4. The remarks, if a replacement already exists. Match the remarks to the path: old registration number after a down-class move; adjusted class and a capped date on a conditional old-class renewal; a recorded request where a tender still needs the old number.1, 2
  5. The cancellation position, if a new-class certificate has been issued. The holder must have applied to cancel the original certificate, or the original authority carries out that procedure. For a Class I filing moved up, the corresponding record is cancellation of the filing.1

A class move can also change which China UDI production clock applies. That clock is a later question. It is set out in the Class II UDI production clock guide, and this announcement does not restate it. A valid transition also does not replace the factory file under NMPA GMP Announcement No. 107. That file is the subject of the Announcement 107 factory-qualification guide.

Contract language can record the same request: notice of a published adjustment that names the product, a copy of that document, and a shipment warranty that the lot was made under a certificate or filing that still meets the row above. Those are commercial asks. They are not extra statutory deadlines. Ten business days, a quarterly dossier report, or a six-month termination right would be terms the parties write. Announcement No. 52 does not impose them.

Where VEMERIX fits—and where due diligence still begins

VEMERIX is the international brand of Weihai Medison Medical Equipment Co., Ltd., positioned as a Minimally Invasive Surgery Total Solution Platform serving urology, vascular surgery and perioperative care.

Announcement No. 52 does not reclassify any VEMERIX or Medison product. The public pages below are illustrations of the document types the procedure distinguishes. They are not evidence that a class moved. The next evidence step is still the certificate or filing itself, plus the adjustment document if a supplier later says one applies. A buyer can request those documents through the contact page.

  • Circumcision device. The product page records a Class II registration, Lu Mech Reg. 20172020238, for the self-detaching ring.10 That number is not the circumcision anastomat kit and not the circumcision stapler. Those are separate registrations.
  • Circum-CARE pants. The product page records a Class I filing, Lu Wei Mech Filing 20190014.8 A filing number is the document a down-class-to-Class I path would have to be compared with. This page does not say the filing was produced by a class adjustment.
  • Disposable medical laser fiber. The product page records a Class II registration, Lu Mech Reg. 20192010517, for a 1470 nm single-use fiber used with a partner-supplied diode laser source.9 Medison does not manufacture or register that console. The fiber registration is not a console registration.

Frequently asked questions

Does Announcement No. 52 of 2026 reclassify a circumcision device, laser fiber, NPWT pump, or Class I filing?
No. The announcement has no product annex.1 The circumcision-ring page records Class II Lu Mech Reg. 20172020238.10 The laser-fiber page records Class II Lu Mech Reg. 20192010517.9 The NPWT pump page records Class II Lu Mech Reg. 20182140303.11 The Circum-CARE page records Class I filing Lu Wei Mech Filing 20190014.8 A reclassification would require a later adjustment document that names the product or its category.

Is a two-year or five-year grace period already running for every Chinese device?
No. The interpretation quotes procedure Article 10 as generally using two years, or three years if a clinical trial is required, when a future adjustment brings a product under Class II or III or moves it to a higher class, with a special-case ceiling of five years in principle.2 That quotation did not start a transition on 1 June 2026. The end date, if any, is in the adjustment document for that product.

If a product leaves medical-device regulation, does the old certificate stay valid until it expires?
Announcement No. 52 does not say so. From the attribute-adjustment day the product is no longer regulated as a device, new device filings and registration applications stop, and unfinished reviews are terminated and archived.1 A summary that treats validity until expiry as an express rule of No. 52 is ahead of the text.7

Does a one-off NMPA classification letter follow Announcement No. 52?
No. The interpretation limits No. 52 to an NMPA adjustment of a specific device or a whole category, published as an announcement. An individual classification determination made for a regulatory need follows the registration rules and the classification-defining announcement.2

Can a distributor keep selling inventory made before the transition end?
Not on the strength of No. 52. Where a transition is set, Section I(7) and Section II prohibit production, dealing, and import from that end if the required certificate or Class I filing is not in place. The announcement does not add a labeled-expiry sell-through.1 Goods that have already left China are a question for the destination authorization. No. 52 does not answer that question.

What if a destination file still relies on the old Chinese number?
Ask the supplier for the replacement document and for the remarks content the relevant path requires. If the tender still needs the old number, the interpretation says the applicant must request that the original registration or filing number be noted when the application is submitted.2 That note supports a continuity explanation. It does not, by itself, guarantee that a foreign authority will keep the existing authorization.
